On the one hand, I really can’t blame this guy for falling asleep in class. We’ve all done it, even the honor roll students nodded off every once in awhile during the English teacher’s Ayn Rand lecture. On the other hand, I also can’t blame this guy for filing a lawsuit because his obvious lack of intelligence shows he really didn’t stay awake during class very often.
According to the AP, a student filed a lawsuit because her teacher woke him up during class.
The suit claims the teacher made a loud noise and caused severe injuries to his ear drum. The good news is he won’t have to take the hearing test the school district requires every year.
She made the noise by slamming her hand down on his desk. In my day, if the teacher slammed her hand down on the desk, that just means she missed.

You know that if the teacher hadn’t woken up the student (whatever the gender might be), and the student failed the course, the teacher would be sued for not making the student pay attention. Wake-up people! (pun intended) Schools are not for babysitting and entertaining students! They’re for education! DUH!

What a wuss! When I fell asleep in class or wasn’t paying attention my teacher smacked me on the head with her textbook! Yes, this was at a Catholic Middle School but this happened only about ten years ago!

The correct thing to do would be to let the student keep sleeping, in the event that the teachers hand would make such a loud noise on the desk it would damage the student’s eardrum ( a zero in a million chance.) Power to the sleepers!

uh, C.A. are you the moron (by the way, the word “retard” means to be held back and has become a demeaning term to those who are mentally “held back” through no fault of their own and should not be ridiculed)? I can understand how she could perhaps make the lesson more interesting, but she is NOT responsible for entertainment. People like you who expect entertainment for everything (including school) are exactly what is wrong with today’s society. What happened to appreciating education? It’s something that many don’t have even a small chance to receive. And did you ever considered that the teacher isn’t thrilled with teaching the material? I can tell you that as a teacher myself (and the daughter of two high school teachers) that there is plenty of “crap” that we have to teach. Sometimes it is even scripted and we HAVE to teach it that way, even if we know it doesn’t work for our students. Trust me, it drives all remotely good teachers NUTS!
So to all who think the student was remotely justified or that the teacher should be held for any responsibility: grow up! The world was not made to entertain you, you must find your own entertainment within it.

( due to an acccidental OD of Benadryl) and the teacher woke me up. At least I had the decency to apologize to her. That is what he or she or it should have done.

We had a math teacher who sprayed students who fell asleep with water. Just one quick squirt to the face with a spray bottle.

I just graduated in 2008, and due to working night shift all of the time, I slept in class a LOT. Not something I’m proud of, and entirely my fault, so I would never dream of blaming a teacher for waking me up.
Even though one of mine would walk my, shake the desk and scream “EARTHQUAKE!” – Quite an unpleasant way to wake up. Still, you don’t have to worry about that and stay awake and pay attention like you’re supposed to. >.>
