It looks the 1-800-Flowers lawsuit filed last August has up and wilted away like a lone rose in a barren desert; no water to feed it, no wind to caress it, no love to keep it alive.
Speaking of no love, a judge tossed out the suit of a man who sued 1-800-Flowers for delivering flowers to his wife that were meant to go to his girlfriend, according to OnPoint.com. Read about the original story here at Dumb-Lawsuits.com.
The judge claims the case couldn’t be tried in Texas because of the terms of use, which apparently includes playing on your girlfriend’s emotions with cheap, shoddy flowers.
The judge claims the terms of use only allow suits to be filed against them in New York where justice is served by a sidewalk vendor on a dirty wooden stick.
The plantiff will move his case to New York, according to his attorney, and score some sweet tickets for “Cats.”

I truly believe that it wasn’t the florist’s fault, he didnt know him personally, so whatever he did, he did out of pure spontaneity and without malice.
It’s his fault for leaving a trail, I mean, sending flowers for your mistress and leaving your home address behind would not make the florist dwell on the specifics too much enough to care.

This ranks right up there with the guy that tried to sue E-Harmony for discriminating against him when they denied his application for a membership based upon the fact that he was married!
