Burger King Gets Flame Broiled

Remember the woman who first spilled hot McDonald’s coffee in her lap? How could I forget her? I wouldn’t have a career if it weren’t for her. Well, her soul has escaped from her body and jumped into another…

An Oklahoma woman who burned herself with Burger King coffee has settled her Greene County lawsuit against the restaurant chain.

Donna Aslanis claimed Burger King was negligent for burns she suffered after she spilled hot coffee from a Rolla restaurant on herself eight years ago.

The former Missourian had sought damages to pay for medical care and other costs because a restaurant employee allegedly failed to tell her the coffee was hot. Springfield attorney Monte Clithero, who represented Burger King, denied the chain was responsible.

The employee denied to tell her the coffee was hot? It’s coffee! It’s supposed to be hot! If fast food employees are supposed to tell us what’s wrong with their food, then every “Flounder” in America should sue Burger King for not telling them that their food would make their hearts explode. Whoops.

The hot coffee incident happened back in 1998 when Aslanis bought two cups of the lava hot beverage at a drive-through window. She poured one of the coffees into her own plastic container when the flimsy lid gave way scalding her legs, thighs, buttocks and genitalia. That’s when she said she learned the coffee was hot - not the steam from the cup, not the “Careful honey, it’s hot” from the underpaid employee, not the label on the side of the cup that said it was hot. It was the scalding of her naughty parts that made her realize it was hot.

After months of litigation, Burger King and Aslanis reached a settlement this week. She received an undisclosed amount, an apology and one of those cardboard crowns.

    Now it’s dumbasses like this who really shouldn’t
    leave their homes. Seriously, it’s a damn shame
    that people like this actually exist, and what
    makes it worse is that they expect other people
    to feel bad for them and also seek financial
    gain just because they screwed up.

    I can’t believe it! What fool doesn’t know that coffee
    is hot??? On top of that she spilled it on herself, it
    was not done by an employee. Didn’t this happen a
    number of years ago with McDonald’s? In my opinion, what
    is worse than this lady actually suing, is that any judge
    would allow the case in his courtroom. He should have
    laughed in her face and thrown the case out on grounds
    of total stupidity! No wonder the courts are so backed
    up!

    I wish a sane person could spill coffee on themself and get money out of it.
    What is becoming of america when you get alot of money for your own stupidity.
    It’s like anything, time and money is wasted on people like this and those that
    need it suffer and go with out. That’s America for ya!

    While it is dumb not to understand that coffee is hot (If I ever did something
    that stupid I’d expect my friends to disown me) the McDonald”s coffee woman won
    because McDonald’s had been warned several times that it’s coffee was too hot for
    human consumption, after all if you get third degree burns on your legs (which
    had much thicker skin than the inside of your mouth) then imagine how badly you
    would burn your mouth drinking. McDonalds ignored the warnings because
    pyschologically people prefer to buy hotter coffee (probably because when you
    finish the commute the coffee is just right. However, either way, coffee is hot,
    and normal people don’t decide to pour it into a different container right over
    their ummmmm naughty parts.
    The BK lady doesn’t have any excuse because EVERYONE knows about the McD incident
    (probably spent way too muuch time thinking about this one)

    A friend of mine’s mother used to work for McDonald’s back when the Hot Coffee
    incident took place with them way back when. He tells me about the dumb stuff
    sometimes, and I can’t believe this woman is pulling the same crap. When will
    people get a life? Or a BRAIN?

    this woman must have been HIGH. duh! who goes to a resturant and expects there
    coffee to be cold. i know if my coffee was cold i’d be mad. everytime you sit
    down to eat a meal at a resturant, isn’t it HOT

    Everybody should know that coffee is supposed to be hot.Also, if she was not smart enough to see the label I liked to know how she got this to court? Second, she was not careful enough not to spill her coffee when it’s that hot.Gotta go, have somone stupid to sue like this woman………..

    I hate how litigous this society has become. I am appalled by burglars that sue because
    they fell in the home they broke into and broke their leg. I’m inclined to be dismissive
    of anybody that “sues”, but….
    Are you sure you know the whole story? The McDonald’s incident was reported VERY badly and
    with bias towards McDs. The older woman spilled coffee on her lap and genitals sitting in a
    car outside of the McDs. Her grown daughter went running into the ‘restaurant’ and begged for
    cups of cool water to help her mother and asked them to call 911. They refused to give her
    the water without charging her, so she paid them. They refused to call 911 and a bystander
    (I believe) did it instead. After her mother was being treated for what turned out to be 3rd
    degree burns (why is the coffee THAT hot?)in the hospital, the woman contacted the McDs.
    She explained what had happened and said that she thought the coffee was really being served
    too hot. She did not demand money, or assistance with her moms bills. They were incredibly
    rude to her. When the McDs attorney appeared in court he indicated that only 11% of people
    that buy their coffee have ever complained of having to seek medical attention because of
    burns. And only 1% of those people had to be hospitalized. He was cold and dismissed the
    pain and scarring of those people as statistically insignificant. Mcd’s serves billions
    of people. What is 1% of a billion? What is 10% of a billion? The money awarded in the suit
    went to a charity for burn victims. The woman that sued did not profit.

    I am very glad to see that others have written to explain the McDonald’s incident as that really was not as was reported through the media. Not only (as noted) had they been warned about the temperature of their coffee, if I remember correctly it was 40 degrees higher than the coffee one makes in their average coffee maker at home and above regulations.

    This does not mean that if in this particular case the simple argument is that the employees failed to tell her that it as hot… well DUH!

    Apparently, you angry readers out there do not have all the information. McDonalds has been cited hundreds of times for serving coffee at temperatures well above regulation. Furthermore, there has also been numerous cases when people have been injured. This particular woman actually received third degree burns.

    Everyone knows coffee is hot, but when it is nearly 200 degrees hot and can burn you so bad enough to send you to the hospital, shouldn’t it be McDonalds’ fault?

    This is all dumb. People these days sue over the littlest things but I think they should really think about what they are doing. i mean if this girl had that bad of burns then she should’ve sued but I mean people that say something happened that didn’t its crazy. Like what if someone fell at a store because the floor was slippery should they not sue because they should have known the floor was wet or should they sue because the store didn’t set out the signs that said the floor may be slippery? Think long nd hard about that one and comment back to let me know how ya feel.

    I remember this case and like you, I felf that this case was
    entirely without merit. I disagrre with the fact that this case
    was even heard. Even though this case was ridiculous, every
    person has the right to be heard. When you consider the costs
    involved in litagation such as court costs, attorney fees, lost
    work and the damage done by the media who covers the case, is it
    any surprise that McDonalds would offer a setlement? no.
    It was cheaper to pay a small settlement and close the matter.
    In my opinion, the decision to quietly sweep this under the rug
    opens Pandoras box, where we will see alot more of these
    ridiculous lawsuits because she got away with it.
    Remember the old expression ” The squeaky wheel gets the oil”
    That is what happened here..Three people made money off this case
    and they are the plaintif, her attorney and McDonald’s atorney.

    Well - I actually saw photos of the injuries the woman, who
    sued McDonald, had to suffer from.
    I don’t know of anyone, that has seen them, that will ever
    make fun of that lawsuit or put it the category of frivilous
    litigation.

    For all of those ridiculing things like that - without having
    the facts - may you be broiled by a cup of coffee in your lap,
    that was as hot as the one of that incidence.

    I can not believe they actually settled with her!! I would of told her to go fuck herself
    and any judge that would of let her win that lawsuit should be stripped of his title
    cause that is a bunch of crap!! When you order coffee you want it hot!! YOu don’t hear anyon
    anyone saying can I please get a cup of cold coffee!! If the coffee was cold she would
    have bitched and tried to get her meal free, but since the coffee was hot like it was
    suppose to be she suing McDonalds on the grounds of shes stupid and shouldn’t have been
    able to fix coffee by herself to drink. What a moron!!!

    This has got to be the stupidest thing I have ever seen before in my life. People don’t want to earn there money the honest way. They want everything handed to them on a silver platter. In this case in form of a check. But, the biggest dummies are the lawyers for Burger King. I wouldn’t have settled for anything. This case would have been in litigation for years and years. By the time it would have been settled out of court Burger King wouldn’t even exist and her family would have forgotten all about the stupid law suit. And if they did remember, they would be to embarrassed to tell anybody that they were related to this crazy, greedy lady.

    now thats just really retarded….ok umm i am thinking of suing BK…i worked for them and we have a new owner and they are not giving any benefits!!! aren’t companies supposed too???
    if you work 40 hour I’m pretty sure they are and if not don’t they have to make you sign a waver saying it will go on your next pay check???? whats wrong with these stupid owners??? the pay is crap, all holidays are open and theirs no bonus or double pay, its all crap….can any one that knows about company laws or just law help???

    sometimes i wonder how these people survive the everyday life .. apparently some of these have the biggest challenge when then go out side .. when they managed the obstical called openening a door

    The only people more stupid than these fools who sue are the juries who agree with them. It turns one fool into 13.

    If juries would use common sense and turn some of these nut cases down, then the companies wouldn’t be compelled to settle out of court.

    Of course, we all better worry that Aslanis will sue us for making fun of her stupidity….wait, not to worry, she obviously can’t read, so we have nothing to worry about. (it says “HOT” on the cup fool!)
