A 21-year-old has sued Pepsi for breach of contract after he did not receive his intended reward in the “Pepsi Challenge”. John Leonard, a business student, obtained 7 million Pepsi points with the help of several investors (you could buy the points from Pepsi for 10 cents apiece). He delivered to Pepsi a check for $700,008.50 for the points “plus shipping and handling”. His intended reward, a Harrier jet, was advertised in a Pepsi commercial as costing 7 million points. However, Pepsi now claims it was just a bit of humor and refuses to adhere to what the ad promised.

It would serve him right to actually get one, and have to pay for it to be moved, stored and maintained.

They should be required to give it to him. They made the offer they have to fulfill it. Otherwise face false adverstising charges.

The ad had fine print at the bottom explaining that is was NOT an actual prize.
